Acceptance of Terms
Spine and Disc Center of Washington (“we,” “our,” or “us”) provides its website, mobile app, and related services (collectively, the “Platform”) to you subject to the following User Agreement (“Agreement”).
If you do not agree with any of the terms of this Agreement, do not access or otherwise use the Platform or any information contained on the Platform. Your use of the Platform shall be deemed your agreement to abide by each of the terms set forth below.
We may change this Agreement at any time by posting an updated User Agreement on the Platform and may send registered users an email notice of the changes. If any modification is unacceptable to you, you must cease using the Platform. If you do not cease using the Platform, you will be deemed to have accepted the changes.
When you use any of our services, you will be subject to our Privacy Notice, which is incorporated into this Agreement by reference.
User Account, Password, and Security
To complete registration, you must provide an email address and password. You are responsible for maintaining the confidentiality of your password and account and are responsible for all activities that occur under your account.
You agree to:
- Immediately notify Spine and Disc Center of Washington of any unauthorized use of your account or any other breach of security.
- Ensure that you log out of your account at the end of each session.
We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
User Conduct
By using the Platform, you agree not to:
- Upload, post, email, or transmit any content that is unlawful, harmful, threatening, abusive, vulgar, harassing, defamatory, obscene, pornographic, profane, indecent, inflammatory, libelous, hateful, or otherwise objectionable, or invasive of another’s rights.
- Impersonate any person or entity, or misrepresent your affiliation.
- Upload or transmit content that violates intellectual property rights without permission.
- Encourage criminal activity or violate laws.
- Harm minors in any way, including uploading content that violates child protection laws.
- Upload unsolicited advertising (“spam”), viruses, or malicious code.
- Disrupt or interfere with the Platform’s operation, security, or other users’ enjoyment.
- Access restricted areas without authorization.
- Harvest information about users without consent.
- Violate any other rules outlined in this Agreement.
Order Change Policy: Customers have 48 hours from their last communication with Spine and Disc Center of Washington regarding their order/design to request modifications. After this time, production will begin and changes may not be possible.
We reserve the right to review, reject, or remove any content for compliance with this Agreement.
Privacy Notice
Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect and use your information. By accepting this Agreement, you consent to our collection and use of your personal information as described therein.
Trademarks, Copyrights, and Proprietary Rights
Our trademarks, trade dress, and product images may not be used in any way that could cause confusion or discredit us. Content on the Platform may be protected by intellectual property laws, and you may not use it without authorization.
When you upload content, you:
- Represent that you own the rights or have full permission to use it.
- Grant us a non-exclusive license to use it for the purposes described in this Agreement.
- Remain responsible for the content and any legal claims related to it.
Intellectual Property Policy
We respect the intellectual property rights of others and may terminate accounts or cancel orders that infringe on those rights.
Warranty
You represent and warrant that:
- You own or control all rights to the content you submit.
- The content does not infringe upon others’ rights.
- This Agreement is binding and enforceable against you.
Indemnity
You agree to defend, indemnify, and hold harmless Spine and Disc Center of Washington, its officers, employees, and affiliates from any claims, damages, or expenses (including attorney’s fees) related to:
- Content you submit.
- Your use of the Platform.
- Your violation of this Agreement.
- Your violation of any rights of a third party.
No Resale
You may not reproduce, duplicate, copy, sell, or resell any portion of the Platform without our written consent.
Termination
We may terminate your account or use of the Platform at any time, with or without notice. Upon termination, you must cease all use of the Platform.
Links
The Platform may contain links to third-party websites. We are not responsible for their content, policies, or practices.
Pricing, Shipping, and Terms of Sale
Prices are listed in USD and may change at our discretion. Risk of loss passes to you upon shipment. We may cancel any order for any reason, including intellectual property concerns.
Age and Geographic Restrictions
You must be at least 18 years old to use the Platform. We only accept clients in the United States and its territories.
International Access
If you access the Platform outside the U.S., you are responsible for compliance with local laws.
Correction of Errors and Inaccuracies
We reserve the right to correct errors or inaccuracies and to change or update information at any time, including after you have submitted an order.
Reviews and Comments
By posting reviews or comments, you grant us the right to use your submitted name and content. You are responsible for ensuring your submissions do not infringe upon the rights of others.
Disclaimer of Warranties
The Platform is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
We are not liable for any damages arising from your use of the Platform, except where prohibited by law.
Content Usage Terms
By uploading content (including photos and videos), you grant us a perpetual, worldwide, royalty-free license to use it for commercial purposes, including marketing. You release us from any claims related to such use.
Dispute Resolution and Release
This Agreement is governed by the laws of the State of California. Disputes will be resolved through binding arbitration in Fircrest, Washington, except for intellectual property claims, which may be brought in California state or federal court.
Severability
If any provision is invalid, the remaining provisions remain in effect.
General
This Agreement, together with our Privacy Notice, constitutes the entire agreement between you and Spine and Disc Center of Washington regarding your use of the Platform.
